1. Introduction & Acceptance

Welcome to Cuvly, owned and operated by Aigentro / Cuvly ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Cuvly mobile applications (iOS and Android), backend APIs, websites, and associated digital services (collectively, the "Service").

By creating an account, downloading, or using Cuvly, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Eligibility & Account Security

You must be at least 13 years of age (or 16 years of age in the European Economic Area/UK) to use Cuvly. If you are under 18, you represent that you have received parental or legal guardian consent to use the Service.

• Account Accuracy: You agree to provide accurate and complete registration information (such as a valid email address) when creating an account.
• Credential Safeguarding: You are responsible for maintaining the confidentiality of your login credentials and one-time verification passwords (OTP).
• Immediate Notice: You must promptly notify us at cuvly.support@aigentro.com of any unauthorized access to or compromise of your account.

3. Subscriptions, Trials & Billing Terms

Cuvly offers both a complimentary basic experience and auto-renewing premium subscription options ("Cuvly Pro").

Billing, Auto-Renewal & Cancellation

• In-App Purchases: Subscriptions and in-app transactions are charged directly through your Apple ID or Google Play Account upon purchase confirmation (or immediately following the conclusion of any applicable free trial period).
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the expiration of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.
• How to Cancel: You may cancel auto-renewal at any time through your device platform settings:
  • iOS: Settings > [Your Apple ID] > Subscriptions > Cuvly > Cancel Subscription.
  • Android: Google Play Store > Profile icon > Payments & subscriptions > Subscriptions > Cuvly > Cancel.
• Refunds: All payments and refund requests are governed by the respective terms of Apple App Store or Google Play Store. Cuvly does not store or directly process your credit card numbers.

4. Eating Disorder Safety & Quiet Mode

Cuvly is committed to positive, shame-free nutritional well-being. We deliberately eliminate calorie counting, weight scales, body shaming, and restrictive guilt messaging.

Cuvly provides an optional "Quiet Mode" in Profile Settings that hides numerical sugar measurements and focuses exclusively on qualitative ingredient feedback.

5. Nutritional Data & Barcode Intelligence

While we strive for accurate nutritional intelligence, product formulations, ingredient suppliers, and barcode packaging frequently change without notice. Information displayed in Cuvly is derived from food composition databases, packaging scans, and manufacturer disclosures.

Verification: Always verify allergen warnings, gluten presence, sugar alcohol composition, and critical dietary ingredients directly on the manufacturer's physical product label before ingestion.

6. Intellectual Property & License

All software, proprietary algorithms, visual designs, icons, 90-day reset curriculum, audio cues, and trademarks associated with Cuvly are the exclusive intellectual property of Aigentro / Cuvly. We grant you a limited, personal, non-transferable, revocable license to use the app for personal, non-commercial wellness tracking.

You may not reverse-engineer, decompile, scrape, copy, modify, distribute, or create derivative works of any portion of the Service or its food databases.

7. User Conduct & Acceptable Use

You agree not to:

• Use the Service for any unlawful or abusive purpose.
• Attempt to gain unauthorized access to backend servers, databases, or user accounts.
• Interfere with or circumvent security rate limits or subscription entitlements.
• Submit fraudulent barcode information or malicious user data.

8. Account Termination & Deletion

You may permanently delete your account and all associated telemetry at any time directly in the mobile application by navigating to Profile > Privacy & Data > Delete Account & History. Upon confirming deletion, your personal health history, check-ins, scans, and auth credentials will be permanently erased in accordance with our 30-day purge cycle.

We reserve the right to suspend or terminate accounts that breach these Terms, commit payment fraud, or engage in abusive platform behavior.

9. Disclaimers of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Aigentro / Cuvly, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Aigentro / Cuvly is registered, without regard to its conflict of law provisions.
